As we navigate the "Agentic Era," these five core pillars serve as the legislative foundation for Algorithmic Sovereignty and the protection of independent creators.
Here is the breakdown of the framework that gives the Master Creator License Stack (MCLS) its statutory teeth:
1. Creator Rights
This pillar establishes a human creator’s exclusive right to authorize or refuse the use of their copyrighted works specifically for the purpose of training artificial intelligence systems. This right is separate from and additional to existing copyright protections and applies regardless of whether the work is publicly available or hidden behind a paywall.
2. Transparency
AI developers are mandated to provide comprehensive disclosure regarding the data composition of their training datasets. They must maintain complete and accurate records of all works used and provide individual creators with a specific accounting of their intellectual property’s inclusion within 30 days of a request.
3. Consent & Licensing ✅
No AI developer may use a covered work for training without obtaining express, informed, and affirmative consent or a valid license. Consent cannot be inferred from a work being available online; it must be specific to the AI system and the duration of use.
4. Compensation
The Act creates a fair compensation framework, including a Creator Compensation Fund administered by the Register of Copyrights. Remuneration is determined by factors such as the commercial value of the work, the revenue generated by the AI system, and the degree to which the AI depends on the creator's logic for its capabilities.
5. Enforcement
To ensure these aren't just "suggestions," the Act provides robust teeth through both FTC agency action and a private right of action. Creators can sue for actual damages or statutory damages ranging from $2,500 to $250,000 per work**. Willful violations with intent to defraud carry criminal penalties of up to **$1,000,000 and 5 years in prison.
